Is it possible to rent out an apartment daily in Turkey? License, neighbors' consent, and fines

Apartments on the Turkish coast are often purchased with the expectation of making money by renting them out to tourists on a daily basis. Since 2024, this practice is only permitted in compliance with Law No. 7464: permits from the Ministry of Culture and Tourism are required to rent out apartments for tourists in Turkey, and resorts are subject to regular inspections. It's best to understand the regulations before purchasing a property. Whether you can rent out your apartment on a daily basis depends largely on the residential complex, including its infrastructure and whether it has permission to rent out apartments on a daily basis. The fine for renting out apartments without permission in 2026 will start at ₺180,617 and reach ₺1,806,177 per apartment.

What is considered a daily rental under the 100-day law?

Law No. 7464 entered into force on January 1, 2024. In Turkey, tourist or daily rentals are defined as any rental of housing under a single contract for up to 100 days, regardless of who the tenant is and the reason for their stay: a tourist, a business traveler, a relative, or an acquaintance. Contracts longer than 100 days are not covered by the law; they are considered standard long-term rentals.

Permits must be obtained before signing the first contract; they cannot be issued retroactively. Another precaution against circumventing the law: if a single property is rented more than four times under contracts lasting over 100 days within a year from the date of the first contract, the owner faces a separate administrative fine. This rule is expressly provided for in Article 4 of Law No. 7464.

Daily Rental Permit: Who Can Get It and What Are the Apartment Requirements?

To rent out an apartment in Turkey on a daily basis, you need a tourist rental permit (izin belgesi). This is issued by the Ministry of Culture and Tourism. The application must be submitted online through e-Devlet, Turkey's government services portal. It must be submitted by the owner. Under no circumstances are tenants allowed to rent out someone else's apartment on a daily basis. The application is reviewed for up to 60 days, and after the permit is issued, the property is visited for an initial inspection.

According to the regulations, an apartment must have a sleeping area, a bathroom with hot water, a cooking area, and a fire extinguisher. Effective October 10, 2025, these requirements were supplemented by smoke detectors in all rooms with fixed partitions (except bathrooms) and a guest card with house rules and evacuation routes.

Once a daily rental permit has been received, a sign reading "TURİZM AMAÇLI KONUT" is hung at the entrance, and the permit number is included in every listing on Airbnb and Booking. Listings without a site number are deleted. Each guest must be registered with the police in accordance with Law No. 1774 on Identity Registration. Renting out rooms to different guests separately is prohibited; the permit is issued for the entire apartment. The property is inspected at least once every two years.

What to prepare for the application:

  • owner's passport, for a foreigner - a copy of the passport;

  • a current extract of the TAPU for the apartment;

  • a notarized unanimous decision of the building owners, if the complex does not include housing with hotel service;

  • a notarized power of attorney if the application is submitted by a representative;

  • the apartment itself, equipped according to regulations: a fire extinguisher, smoke detectors, an information card.

The Ministry set the permit price for 2026 at ₺10,000 per document and ₺10,000 for the required sign. That's a total of ₺20,000 per apartment.

The most difficult part is collecting neighbors' signatures. A notarized decision from all building owners is attached to the application, and it must be unanimous: if even one owner is against it, permission will not be granted. Persuading a dissenting neighbor after the purchase is almost impossible, so it's best to negotiate before the transaction, either personally or through a lawyer and the management company. In a complex with several buildings, the consent of the owners of each building is sufficient. There's also a 25% rule: in a building with more than three apartments, one owner can obtain permission for no more than a quarter of the apartments. A separate requirement arises when there are more than five apartments per landlord in a single building: a permit to open and conduct the relevant business (işyeri açma ve çalışma ruhsatı) is also required.

An exception is made for yüksek nitelikli konut (complexes with hotel services), including reception, security, and daily cleaning. If the management plan for such a complex (yönetim planı) explicitly permits short-term rentals, neither a unanimous decision nor a 25% limit is required. It is assumed that the service and management company will already ensure proper guest care.

Therefore, if real estate in Turkey is purchased for rental purposes, the management plan, level of service, and the neighbors' attitude are checked before the transaction.

Fines for daily rentals without a permit in 2026

Fines are indexed annually, so they need to be updated for the year of inspection. As of 2026, the fines under Turkey's daily rental law are as follows: For a first violation, the fine is ₺180,617 per apartment and 15 days to obtain a permit. If the rental continues, the fine is ₺903,088 and an additional 15 days. Subsequent violations are ₺1,806,177. The fine is determined by the governorate where the apartment is located.

An intermediary who rents out someone else's apartment without permission pays ₺180,617 for each contract. Real estate agencies are prohibited from doing this; only Group A travel agencies can legally act as intermediaries. For Airbnb listings in Turkey, starting April 1, 2026, hosts must provide the following information for permit verification:

  • permit number;

  • name of the permit holder;

  • address of the object.

Information is verified against government data. Listings with invalid or outdated information cannot continue to accept bookings on the platform.

If, following the inspection, the deficiencies are not corrected within the specified timeframe, the permit may be revoked.

How to legally rent out an apartment: options for the owner

There are four viable options. If the neighbors agree, the owner can obtain permission themselves. One can purchase an apartment in a special category complex (yüksek nitelikli konut), where the management plan already permits short-term rentals: then neither consent nor the 25% limit are required. One can transfer the apartment to a Group A travel agency, which has the right to rent it out. Finally, one can rent it out for periods longer than 100 days, for example, during the winter season: permission from the Ministry of Tourism is not required for such a contract.

Income from daily rentals in Turkey is taxable. Individuals are subject to a progressive income tax rate of 15% to 40%. We discuss how to calculate and declare this tax in a separate article.

FAQ

1

Can a foreigner obtain a permit without a residence permit?

Yes. The permit is issued to the owner; citizenship and residence permit status are irrelevant. If e-Devlet is not available, the application is submitted by a representative with a notarized power of attorney.

2

Do I need permission to rent out an apartment for the winter for 4-6 months?

No, if the term of a single agreement exceeds 100 days: this is a standard long-term lease, and Law No. 7464 does not apply. However, there must be only one agreement for the actual duration of the stay.

3

Is it possible to rent out individual rooms in an apartment on a daily basis?

No. The regulations prohibit renting out rooms to different guests separately: a permit is issued for the entire apartment.

4

Do I need to pay tax on daily rent?

Yes, income from tourist rentals is taxable in Turkey, regardless of its size. The calculation and declaration procedures are discussed in a separate article.

5

Can a real estate agency rent out my apartment on a daily basis?

Only if he has a Group A travel agency license. Without one, both the owner and the broker are fined for daily rentals.
